Rassistisch motivierter Versuche Mord an Romafamilie – Urteilsverkündung

Prozessende und Urteilsverkündung  am 4. November um 9:00 Uhr im Kriminalgericht Moabit, Turmstraße 91, Raum 1/537, 10559 Berlin

Zum Fall: Am 29. März 2019 waren unsere Freundin Maria, ihr Mann und ihr Schwager in einer Berliner UBahn unterwegs, als sie von einer weißen deutschen Frau mit einem Messer attackiert wurden. Sie wurden zum Teil lebensgefährlich verletzt und leiden immer noch an den körperlichen und psychischen Folgen des rassistischen Angriffs.
Seit dem 23. September läuft im Kriminalgericht Moabit das Verfahren gegen die Täterin. Obwohl sie große Angst vor Folgeangriffen hatten, traten Maria und ihre Familie als Nebenkläger_innen auf und wurden als Zeug_innen vernommen. Da die Frau während der Tat Roma rassistisch beschimpft hatte gehen wir, zahlreiche Romaverbände und Unterstützer_innen von einer rassistisch motivierten Tat aus.

Zum Verhandlungsverlauf: An sechs Verhandlungstagen wurde der Fall verhandelt. Auch wenn das rassistische Motiv der Tat durch viele Zeugen belegt werden und nicht geleugnet werden kann, wurden vor Gericht weder der offensichtliche Rassismus noch die  psychischen und gesundheitlichen Konsequenzen des Angriffs ausreichend benannt und berücksichtigt, sondern hauptsächlich die Zurechnungsfähikgeit der Angreiferin. Es ist eine Tradition in der deutschen Rechtssprechung, dass rassistische und antisemitisimitische Taten gar nicht erst anerkannt werden oder als Einzelphänomene nicht zurechnungsfähiger individueller Täter_innen abgetan werden.  Auch falls das Gericht am kommenden Montag zu dem Punkt kommt, dass die Täterin nicht zurechnungsfähig war, möchten wir betonen, dass das Motiv der Tat Rassismus ist und auch als solcher benannt werden soll. 

Wir möchten, dass der Fall öffentlich bekannt wird. Romni treten in deutschen Gerichten äusserst selten als (Neben)Klägerinnen auf.  Auch in der deutschen Presse wird selten über rassistisch motivierte Straftaten gegen Roma berichtet.

Es ist wichtig, dass viele Menschen zu diesem Prozess kommen. Zeigen wir Maria unsere Solidarität. Zeigen wir ihr, dass sie nicht alleine ist. Rassismus gegen Roma muss sichtbar gemacht werden.

Racist attempted murder of Roma family – verdict pronouncement

End of trial and pronouncement of judgement on 4 November at 9:00 a.m. at the Moabit Criminal Court, Turmstrasse 91, Room 1/537, 10559 Berlin, Germany

About the case:  On March 29, 2019 our friend Maria, her husband and her brother-in-law were travelling in a Berlin subway when they were attacked by a white German woman with a knife. They were injured, some of them were in a life-threatening condition, and they are still suffering from the physical and psychological consequences of the racist attack. Since September 23, the trial against the perpetrator runs at the Moabit Criminal Court. Although they were very afraid of subsequent attacks, Maria and her family  appeared alongside the state on the prosecuting side and were questioned as witnesses. Because the woman used anti-Roma racist language during the assault, we assume that the crime was racially motivated. This opinion is shared by numerous Roma associations and supporters.

About the process of investigations: The case was heard on six days. Even if the racist motive of the crime is proved by many witnesses and cannot be denied, neither the obvious racism nor the psychological and health consequences of the attack were sufficiently named and considered in court, but mainly the accountability (sanity) of the attacker. It is a tradition in German jurisprudence that racist and antisemitic acts are not even recognized or dismissed as individual phenomena of individual perpetrators who are not accountable.  Even if the court next Monday reaches the point that the perpetrator was not accountable, we would like to stress that the motive of the crime is racism and should also be named as such.

We want this case to be public! Romni (Roma women) rarely take perpetrators of violence against them to court.  Racist crimes against Roma are rarely reported in the press. It is important that many people come to the trial on the 23rd.

Let us show solidarity, let us show Maria that she is not alone!
Racism against Roma must be made visible!
